<hr />Reply:If you want to sent an ITS, that&#39;s your decision.  I try never to contribute to someone&#39;s decision to sue or not to sue.  It is such an important personal and financial decision.</p>
<p>I would say that you shouldn&#39;t say anything verbally or in writing that you&#39;re not prepared to follow through on.<br />

<hr />Reply:Ha, you weren&#39;t the only one who was VERY surprised when the current verizon-account showed up on the credit-report. I called them to see what&#39;s going on and the best thing was that they had no idea about this reporting (according to verizon, only accounts in default would be reported&#8230;.).</p>
<p>Yeah, Verizon should at least tell their customer service that they started reporting on a regular basis, even on current accounts.</p>

It showed me only the account of the sale of a pile of debt. Who says that its my fault? <br />rn<br />rnWie I should reply in writing the law, as this is the only method that I use, to communicate with any debt collector?<br />

<p>The fact that you received something in the mail is enough to defeat the motion. New York courts are painfully slow, anyway. I&#39;ve got two or three cases at work that have been waiting for a hearing date for nearly two years. A year is nothing. Don&#39;t waste your time.<br />

<hr />Reply:I think the language in your note is a bit strong.  Personally, I don&#39;t want to be forced to go to court, and in the end, I&#39;d rather negotiate with the guy in writing without actually negotiating with the lawyer.</p>
<p>Then by all means, use only part of my suggestion, and tone it down.</p>
<p>How about:<br />
The documentation you have provided is not satisfactory ( or maybe &quot;inadequate&quot; is better).  In order to resolve this matter, I require a complete accounting of how plaintiff arrived at the amount he is claiming, proof that my account is included in the blanket bill of sale you provided, and (whatever else you want.)  Due to the serious nature of this matter, I request that all communication be in writing, so that I may have records for my files.</p>

<p>On further consideration:  you&#39;re no longer in the DV phase.  You&#39;re engaged in a lawsuit.  The things I mentioned are better requested through the formal Discovery process.  Since this varies from state to state, you need to find out the right format for your state.  DH<br />
<hr />Reply:but keep in mind several important things.</p>
<p>1)  If you settle for an amount less than is showed owing, they can sell that difference to another debt collector &#8211; make sure you get in writing that it is a full settlement and that the balance will not ever be sold.</p>
<p>2)  Get them to take account off of your credit reports if possible &#8211; they may argue they cant make changes or they have to report accurately, so you just ask them to take account off, nothing says they have to report account, but if they report account it must be accurate.</p>
<p>3) Be prepared for any tax consequences &#8211; if it is over (I think it is $600) they will probably send you a 1099-c, not a big deal if it is a small amount.</p>

<p>Well, no-no might be putting it strongly&#8230;  To me, me personally contacting him for a settlement via phone just sounds like he&#39;s A) going to try and take advantage of me and B) realized he can&#39;t win the case in court.</p>

In the end, I do want to settle the debt, but of course, I won&#39;t have enough liquid cash until Tax Time. So what I&#39;m trying to ask is how can I get the situation delayed until February when I know I&#39;ll have money to negotiate. I guess what I&#39;m looking for is a viable note to come back at him with that puts the onus on him to get proper validation. </p>
<p>I mean, can I ask for original signed contracts with the Origial Creditor to further prove that they are now the owner of the debt, and documentation that my specific debt was transferred to their collection company?<br />

<p>Here&#39;s what he sent: Statements from the last 18 months and the chain of title of the debt. the chain of title of debt is two statements:  One was the group who bought a group of debts from the original creditor: (don&#39;t know if I&#39;m part of this or not) and an Assignment of Accounts to this laywer. Again, nothing with my name on it.  The only thing with my name is statements from the original creditor.<br />

<hr />Reply:No, it is not a FICO score. It is a PG score based on EQ&#8230;for whatever that is worth. It may help show trends and the results of different actions on your account, but that is probably about it.<br />
<hr />Reply:The score you get on PG is based on your equifax report but it&#39;s calculated by PG and not EQ and I don&#39;t think it&#39;s really a FICO score.<br />

Both can help you figure your taxes for each year as well as represent you with the IRS and tax court, if necessary. <p>All they have to do is remerge the file and delete some of the soft inquiries so it can go back together. </p>
<p>Recommend if you are using a monitoring service that stop, this might reset some of the past information if you have been disputing prior to the split. Like one step forward and two steps back.<br />
<hr />Reply:It&#39;s bad.  It means you have 2 files with things split between them.  When they merge them it will often include items that have been deleted.  Go through your paperwork so you can show them what items have been deleted.<br />

please understand that when you pull your report from privacy guard, they are not true fico scores. they are privacy guards interpretation of what they think your fico would be. they are not the real thing and they are not totally accuarate. look at my signature in this post and you will see what i mean.</p>
<p>on myfico, you can continually pull equifaxes score, however you can&#39;t get the total report all the time.</p>
<p>i have privacy guard for watching what gets posted to my report. it is not accurate for monitoring my scores, though.<br />

<hr />Reply:I am not sure about the alerts part, I never really payed to much attention to that, but the PG account set up you can do online, then they send you a security code in the mail to access it for the first time, but you do not have to wait, all you have to do it call PG and tell them you would like your code, they will verify you with a few pieces of info and give it to you right over the phone.<br />

<hr />Reply:Here you go&#8230; I am also using PG currently myself, if you go straight to the PG site given they only offer $1 for 2 months then the $100+ annual fee, If if you plan on keeping it longer, thats pretty steep. But I was doing some searches and found a link that gives you a $12.99 a month after the trial. I am not sure if signing up straight from going to PG site gives you the 3CR and 3 Scores, but this one does.</p>

<hr />Reply:looks like no one really has anything bad to say about PG.  I had some trouble with them when I went to cancel because we had the 3 month free thing.  Be cause DH and I were both using the system, even though we were under different credit cards, they took 2 days longer to cancel his because we were &quot;in the same household&quot;.</p>
<p>they did refund my money and the bank reversed the over draft charges caused by the Full year payment up front that they charged my bank account.</p>
<p>But, for the most part, I am satisfied with their service. Its good to use if you are just watching your reports, while you are disputing etc.</p>
<p>The only way to get all the info you need is to buy your full report.</p>
<p>I would recommend buying a new one every quarter. If you are doing aggressive repair.<br />

<p>If you want to get a hard copy of an actual bureau credit report, I too just claim denied credit and presto I get a new report. Also, you can work off that report by disputing something every 60 days or just claim denied again.<br />

<hr />Reply:PG is the best for monitoring.  I pull PG everyday.  I pull my credit report whenever&#8230; in disputes (once they are returned) they must send you a new copy.  You can work off of those forever. In the case I am not disputing lately.. I just claim denied credit or whatnot. It is not hard to get a free CR.  I pull MyFico every 3-6 months when I know a few things have changed or updated. I don&#39;t know that there is anything to pull Ficos daily.. but I don&#39;t really see that it is nessesary. <hr />Reply:I&#39;d like to know this too&#8211;I actually tried freecreditreport.com, but the problem is, they are an experian company, which means they only really complete information they give is for their own company. I was disappointed because they didn&#39;t give the contact information for any of the creditors, except for the ones listed on their report&#8211;and I have stuff that&#39;s 10 years old that my ex husband put on there. It&#39;s not like I have that information!</p>
<p> I suppose it doesn&#39;t matter that much, but I would have appreciated something a little more complete if I was going to be paying for it every month.<br />
